Terms of Service

1. Agreement

These Terms of Service ("Terms") govern the use of all services provided by DIGITALUP GROUP, LLC, operating under the brand DIGITALUP HOSTING ("Company", "we", "our", or "us").

By accessing our website, creating an account, purchasing services, or using any service provided by DIGITALUP HOSTING, you agree to be bound by these Terms.

If you do not agree with these Terms, you may not use our services.

2. Services

DIGITALUP HOSTING provides web hosting and related infrastructure services, including but not limited to:

  • Shared Hosting
  • VPS Hosting
  • Cloud Hosting
  • Website Hosting Solutions
  • Email Services
  • Related Digital Infrastructure Services

We reserve the right to modify, suspend, or discontinue any service at any time.

3. Eligibility

You must be at least eighteen (18) years old to purchase or use our services.

By using our services, you represent that:

  • You have legal capacity to enter into a binding agreement.
  • All information provided is accurate.
  • You will comply with all applicable laws.

4. Account Responsibility

Customers are responsible for:

  • Maintaining account security.
  • Protecting login credentials.
  • All activities occurring under their account.
  • Promptly notifying us of unauthorized access.

DIGITALUP HOSTING is not responsible for losses resulting from compromised account credentials.

5. Payments and Billing

All services must be paid in advance unless otherwise agreed.

Payments may be processed through:

  • Stripe
  • PayPal

Failure to make payment may result in:

  • Service suspension
  • Service termination
  • Data deletion after applicable retention periods

Customers are responsible for maintaining valid billing information.

6. Service Availability

We strive to provide reliable services but do not guarantee uninterrupted availability.

Scheduled maintenance, security updates, hardware failures, network disruptions, force majeure events, or third-party failures may affect service availability.

Unless otherwise stated in a separate Service Level Agreement (SLA), services are provided on an "as available" basis.

7. Customer Content

Customers retain ownership of all content uploaded to their services.

You are solely responsible for:

  • Website content
  • Stored files
  • Emails
  • Databases
  • Applications
  • User-generated content

DIGITALUP HOSTING does not claim ownership of customer content.

8. Backups

Customers remain responsible for maintaining their own backups.

Although backup systems may be provided, no backup system can be guaranteed.

DIGITALUP HOSTING shall not be liable for data loss.

9. Prohibited Activities

Customers may not use our services for:

  • Illegal activities
  • Malware distribution
  • Phishing
  • Spam
  • Fraudulent activities
  • Unauthorized access attempts
  • Distributed denial-of-service attacks
  • Copyright infringement
  • Child exploitation content
  • Content promoting violence or terrorism

Additional restrictions may be defined in our Acceptable Use Policy.

10. Abuse and Enforcement

If we reasonably believe that a customer violates these Terms, we may:

  • Suspend services
  • Restrict access
  • Remove content
  • Terminate accounts
  • Cooperate with law enforcement

Emergency action may be taken without prior notice when necessary to protect our infrastructure, customers, or legal interests.

11. Resource Usage

Customers may not excessively consume system resources in a manner that negatively affects other users.

We reserve the right to limit, suspend, or require upgrades for accounts causing unreasonable resource usage.

12. Intellectual Property

All trademarks, branding, software, website content, and materials owned by DIGITALUP HOSTING remain the property of DIGITALUP GROUP, LLC.

No ownership rights are transferred to customers.

13. Limitation of Liability

To the maximum extent permitted by law:

DIGITALUP GROUP, LLC shall not be liable for:

  • Data loss
  • Lost profits
  • Business interruption
  • Indirect damages
  • Consequential damages
  • Special damages

Our total liability shall not exceed the amount paid by the customer during the three (3) months immediately preceding the event giving rise to the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless DIGITALUP GROUP, LLC and its officers, members, employees, contractors, and affiliates from any claims, liabilities, damages, costs, or expenses arising from:

  • Your use of the services
  • Violation of these Terms
  • Violation of applicable laws
  • Infringement of third-party rights

15. Termination

Either party may terminate services at any time.

DIGITALUP HOSTING may terminate accounts immediately if:

  • These Terms are violated.
  • Payment obligations are not met.
  • Continued service creates legal, operational, or security risks.

Following termination, customer data may be permanently deleted after a reasonable retention period.

16. Disclaimer of Warranties

Services are provided "AS IS" and "AS AVAILABLE".

DIGITALUP HOSTING makes no warranties regarding:

  • Availability
  • Performance
  • Error-free operation
  • Fitness for a particular purpose
  • Merchantability

All warranties not expressly stated are disclaimed to the fullest extent permitted by law.

17. Governing Law

These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in courts having jurisdiction in Wyoming, United States.

18. Changes to Terms

We may modify these Terms at any time.

Updated versions will be published on our website.

Continued use of services constitutes acceptance of revised Terms.
